Terms of Service

1. Service
ReefDesk provides a SaaS platform for diving resorts and dive centres, including reservation management, dive scheduling, guest management, and invoicing ("Service"). These terms govern your use of the Service.
2. Account
You must provide accurate registration data. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at security@reefdesk.io of any unauthorised use.
3. Plans & billing
- The Free plan is free indefinitely, subject to the limits published on the pricing page.
- Paid plans are billed monthly or annually in advance. Annual plans receive a discount.
- Subscriptions auto-renew unless cancelled at least 24 hours before the next billing cycle.
- Fees are non-refundable except where required by law.
- We may change pricing with at least 30 days' notice; existing paid subscriptions keep their price until renewal.
4. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or attempt to gain unauthorised access to the Service.
- Upload malware, illegal content, or content that infringes third-party rights.
- Use the Service to send unsolicited bulk email.
- Use the Service in violation of any export or sanctions law.
5. Data ownership
You retain all rights to the data you upload. You grant us a limited licence to process it solely to operate the Service. See our DPA for processor commitments.
6. Service availability
We target 99.5% monthly uptime, excluding scheduled maintenance announced in advance. No SLA is offered on the Free plan.
7. Termination
You may cancel at any time from your account page. We may suspend or terminate accounts that breach these terms, abuse the Service, or remain unpaid 14 days past due. On termination, your data is exportable for 30 days, then irreversibly deleted within 90 days.
8. Limitation of liability
To the maximum extent allowed by law, ReefDesk's aggregate liability for any claim arising from the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost data, etc.).
9. Indemnification
You agree to indemnify ReefDesk against claims arising from your use of the Service in breach of these terms or applicable law.
10. Governing law
These terms are governed by French law. Disputes are subject to the exclusive jurisdiction of the courts of Paris, France, except where consumer protection law requires otherwise.
11. Changes
Material changes to these terms are announced by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
